(End-User Terms & Conditions)

These Terms of Use (“Terms”) govern your access to and use of the website located at FindAHomeCare.com and any related tools, forms, portals, and services (collectively, the “Platform”) operated by Find A Home Care, LLC, a Delaware limited liability company (“FindAHomeCare,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, discontinue use immediately.
1. Nature of Services — Referral Platform Only
FindAHomeCare is a non-clinical digital referral platform designed to connect families with licensed home care providers, assisted living facilities, and related service agencies. FindAHomeCare:
- Does not provide medical, nursing, or home care services;
- Does not employ or supervise caregivers;
- Does not recommend or endorse any particular provider;
- Acts solely as an intermediary to facilitate introductions between users and providers.
All decisions regarding provider selection, contracting, or care arrangements are made exclusively between the user and the provider.
2. No Medical Advice
All information on the Platform, including articles, listings, care descriptions, or communications, is for informational purposes only and is not a substitute for professional medical, nursing, legal, or financial advice.
Nothing on the Platform constitutes a diagnosis, treatment recommendation, clinical judgment, or guarantee of provider performance.
3. User Eligibility and Accounts
To submit information or request provider matches, you must:
- Be at least 18 years old;
- Provide accurate and complete information;
- Not impersonate another person or entity;
- Not use the Platform for fraudulent or unlawful purposes.
Where the Platform offers user accounts or logins, you are responsible for maintaining confidentiality of your credentials and all activity under your account. Notify us immediately of unauthorized access.
4. Permitted Use & Acceptable Use Policy
You may use the Platform solely for personal, non-commercial purposes related to seeking home care information or provider introductions.
You agree not to:
- Circumvent lead routing, provider contact controls, or CRM systems;
- Scrape, copy, or harvest provider information;
- Upload viruses, malware, or harmful code;
- Interfere with Platform operations or security;
- Use bots, automated tools, or scraping programs;
- Engage in abusive, harmful, or unlawful conduct.
We may suspend or terminate access for any violation of these Terms.
5. Provider Listings and Directory Accuracy
Provider profiles, amenities, pricing, availability, and service descriptions are submitted by providers or third-party data sources. We do not guarantee that listings are current, accurate, or complete.
Users are solely responsible for verifying:
- Provider licensure and compliance;
- Pricing and service availability;
- Caregiver qualifications;
- Insurance, background checks, and operational standards.
FindAHomeCare does not guarantee the quality, safety, or suitability of any provider.
6. Submission of Information & PHI Handling
By submitting information through the Platform, you authorize FindAHomeCare to:
- Receive and store your information, including health-related details;
- Share relevant information with matched providers;
- Contact you via phone, SMS, or email regarding your inquiry;
- Use your information to operate and improve referral processes.
HIPAA Notice:
When information submitted constitutes Protected Health Information (PHI), FindAHomeCare acts as a Business Associate under applicable Business Associate Agreements (BAAs). PHI is safeguarded through administrative, physical, and technical controls consistent with HIPAA.
7. No Guarantee of Provider Availability or Outcomes
FindAHomeCare does not guarantee:
- That a provider will accept a referral;
- That a referral will result in care services;
- The availability, pricing, or quality of care;
- Any outcome, improvement, or safety measure;
- The professional conduct or behavior of providers or caregivers.
All service arrangements are between the user and the provider.
8. Intellectual Property Rights
All text, graphics, forms, software, trademarks, logos, and other content on the Platform are the exclusive property of FindAHomeCare or its licensors. You may not copy, distribute, modify, reverse-engineer, or commercially exploit any Platform content without prior written permission.
9. Limitation of Liability
To the fullest extent permitted by law, FindAHomeCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your interactions with providers;
- Provider behavior, negligence, or performance;
- Errors or inaccuracies in provider listings;
- Service interruptions, downtime, or data loss;
- Decisions made based on Platform content.
In no event shall FindAHomeCare’s aggregate liability exceed $500 or the total amount paid by you to FindAHomeCare in the 12 months preceding the claim, whichever is less.
10. Warranty Disclaimer
The Platform is provided “as is” and “as available,” without any warranties of any kind, express or implied. FindAHomeCare disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability.
11. Indemnification
You agree to indemnify, defend, and hold harmless FindAHomeCare, its officers, employees, contractors, and affiliates from any claims, liabilities, damages, or expenses arising from:
- Your use or misuse of the Platform;
- Your interactions or contracts with providers;
- Your violation of these Terms;
- Your submission of inaccurate or unauthorized information.
12. Third-Party Links and Services
The Platform may include links to third-party websites or services. FindAHomeCare does not control and is not responsible for any third-party content, policies, or practices. Accessing third-party resources is at your own risk.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Disputes shall be resolved as follows:
- Informal resolution: written notice and a 30-day negotiation period;
- Binding arbitration in Santa Clara County, California, under AAA rules;
- No class actions, consolidated claims, or representative actions.
14. Modifications to Terms
FindAHomeCare may update or revise these Terms at any time by posting an updated version on the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
